FAACS online paralegal service allows you to rapidly establish your clients services.
Each year Company Directors are required to confirm and update Company Records to ensure that the ASIC registers are accurately maintained. Fees are paid to ASIC for this service. Late fee penalties may be applied.
Additionally, maintenance is required frequently within the year. Many of these changes also require ASIC notification within a set time period. Late fee penalties may be applied.
Some examples are:
- The Company address changes
- The Company registered office changes
- Directors resign or new directors are appointed
- Shareholders sell some or all of their shares to another party
- Shares are issued to new shareholders
- Shareholder information changes
- A new class of shares is issued
How can FACCS help?
FACCS offers two approaches to company records maintenance. You can keep your own data files, and when you are required to make a change, or undertake annual compliance reporting, you can request us to undertake the required documentation and records maintenance.
Undoubtedly, the most economical way for you is for us to securely maintain your data on our systems. These systems are securely backed up off-line for your protection.
If FACCS created your Company
When FACCS forms your company for you, at your request we will retain and store the information you have provided to us for an annual fee. Because we already have the data on our records, we do not charge an additional fee to set up this process for you.
Included in this annual fee is preparation of the Annual Compliance Reporting. We prepare all documentation for you for your verification and signature.
If your Company was not created by FACCS
Upon request, FACCS will create, maintain, backup and test a secure database of your existing company details for you including secure off-site storage of your records.
Prior to updating our database, we will collect the initial data from the official ASIC records and send it to you for validation and return. If the specific company is not an existing FACCS client, then there is a fee to set up the database.
Once the database is set up
Each time you make a request, we will validate your request against our records. You will be advised of any discrepancy so that you can instruct us what to do.
To make an update, you simply add the changed information to the details we’ll provide you. We will then prepare the appropriate documentation, including any required resolutions, ASIC forms etc, while at the same time updating your company records in our files.
We will also advise you of the impending expiry of your domain name and renew it for you at your request.
Don't want us to create and maintain the database?
We will prepare the requested changes for you on a fee per service basis. We will not retain the data. We will not validate your information. We will not automatically prepare your Compliance returns, nor monitor your Domain Name Registration.
The FACCS fee for records maintenance is lower if we have the database set up.
